With the largest overhaul of the federal income tax code in 30 years and the repeal of the physical presence nexus standards for sales tax in the Wayfair case, the states are working fast and furious to overhaul their tax laws. As some states scramble to fund their budgets, they continue to look for additional forms of revenue. Plan to attend this fast-paced class that covers developing topics in the area of nexus. Learn how nexus requirements have changed and where the state laws may be heading in the future.

Learning Objectives

• Identify changes in state statutes, regulations and case law

• Determine how the states will treat changes under the Tax Cuts and Jobs Act

• Recognize areas that may require additional attention for state tax planning purposes

• Recall areas that may be costly for employers or clients

• Recognize the “who, what, when, and where” of nexus for income and sales tax

Major Topics

• Emerging sales tax topics: Elimination of the physical presence standard in determining nexus (Wayfair case); economic nexus for remote sellers; assisting remote sellers in determining a plan of action in states that enforce economic nexus

• Emerging compliance issues in the new sales tax economy

• Income Tax (and other forms of tax): Economic nexus (taxation without physical presence)

• Will states shift away from income tax and increase reliance on sales tax after Wayfair?

• Treatment of Tax Cuts and Jobs Act by the states: presence of intangible property; is P.L. 86-272 still valid?

• When to consider voluntary compliance even though the laws do not dictate a sales tax responsibility

Accountants who want an update on current multistate tax issues to minimize clients’ potential state and local tax liability

The Ohio Department of Administrative Services (DAS) recently shared with OSCPA that through Sept. 16 only 35% of current OH/ID users have completed required Ohio Business Gateway (OBG) actions prior to an upcoming deadline.

The OBG on September 5 implemented a targeted enhancement for CPAs to simplify and streamline the User Access Request process within the OBG Portal.

This change reduces the number of steps required for Filing Administrators and Filers to request access to Accounts, Service Areas and Transactions.

OSCPA members only have until December 2 before multi-factor authentication (MFA) becomes an OH/ID login requirement for the OBG.  Those practitioners who do not request user access and add their clients prior to Dec. 2 could lose access to filing and paying on the OBG for their clients.

When users log into OBG for the first time with their OH/ID, they will be prompted to associate themselves to their company. See job aid First-time-login-to-OBG-with-new-OHID-Account

Then the user can request access to a business. See job aid Requesting-Access-to-OBG-Existing-Account

If the business that CPAs are requesting access to does not already exist on the OBG, the user will be prompted to register the business first. Please note CPAs should not register their clients’ business on the OBG. The business owner or direct employee must register their business on the OBG first before CPAs can request access. See job aid Requesting-Access-to-OBG-New-Account

The DAS also recently shared CPAs’ most common questions called into their OBG help desk, please click here.  For more information on the upcoming MFA requirement for the OBG, please click here.
